建立共治平臺推進京津冀環保一體化
京津冀(ji)(ji)地(di)(di)(di)區(qu)(qu)是(shi)我國最重要的(de)政治、經(jing)濟和文化(hua)中心(xin),但(dan)三地(di)(di)(di)發展很不平衡(heng),且資(zi)源(yuan)節約和環(huan)(huan)(huan)(huan)(huan)境(jing)保(bao)(bao)護(hu)形勢日益嚴峻,已成為(wei)制(zhi)約京津冀(ji)(ji)區(qu)(qu)域發展的(de)瓶頸。在中央的(de)協(xie)調下,京津冀(ji)(ji)一體(ti)化(hua)已進(jin)(jin)入快速(su)發展階(jie)段(duan),在法治一體(ti)化(hua)模式的(de)指引(yin)下,有(you)(you)關規(gui)劃正(zheng)在制(zhi)定,亟(ji)須建(jian)立與之相(xiang)適應的(de)區(qu)(qu)域治理法制(zhi)、體(ti)制(zhi)和機制(zhi)。如何在法治的(de)框架內進(jin)(jin)行有(you)(you)效的(de)區(qu)(qu)域環(huan)(huan)(huan)(huan)(huan)境(jing)共治,關系京津冀(ji)(ji)環(huan)(huan)(huan)(huan)(huan)保(bao)(bao)一體(ti)化(hua)的(de)成敗,為(wei)此(ci)建(jian)議盡(jin)快制(zhi)定《京津冀(ji)(ji)地(di)(di)(di)區(qu)(qu)環(huan)(huan)(huan)(huan)(huan)境(jing)保(bao)(bao)護(hu)條例》,設立“環(huan)(huan)(huan)(huan)(huan)境(jing)保(bao)(bao)護(hu)專項工作領導小組”,建(jian)立共治對(dui)接平臺,共同推進(jin)(jin)京津冀(ji)(ji)環(huan)(huan)(huan)(huan)(huan)保(bao)(bao)一體(ti)化(hua)有(you)(you)序進(jin)(jin)行。
一(yi)、制定《京津冀(ji)地區(qu)環境保護條(tiao)例》,為(wei)京津冀(ji)環保一(yi)體化提供法制保障
為使京(jing)津(jin)(jin)冀環保一(yi)體(ti)化井(jing)然有(you)序地(di)運轉起(qi)來,有(you)必要制(zhi)(zhi)定(ding)我國(guo)首個《京(jing)津(jin)(jin)冀地(di)區(qu)(qu)環境(jing)保護(hu)條(tiao)(tiao)例(li)(li)》(以下簡(jian)(jian)稱(cheng)(cheng)《條(tiao)(tiao)例(li)(li)》),第一(yi),條(tiao)(tiao)例(li)(li)的(de)(de)起(qi)草由(you)環境(jing)保護(hu)部會同三(san)地(di)政府(fu)共同開展,成熟后報(bao)國(guo)務院審議(yi)發(fa)(fa)布。第二(er),條(tiao)(tiao)例(li)(li)的(de)(de)結構包括立法(fa)目的(de)(de)、基本原則、適(shi)用(yong)范圍、基本政策(ce)、管理體(ti)制(zhi)(zhi)、生態建(jian)設、信息監測與共享、統一(yi)應急、保障措施(shi)、法(fa)律(lv)(lv)責任等(deng)。第三(san),條(tiao)(tiao)例(li)(li)的(de)(de)內容應與國(guo)家(jia)和(he)有(you)關部委已(yi)經出臺(tai)的(de)(de)法(fa)律(lv)(lv)、法(fa)規等(deng)相(xiang)互(hu)銜(xian)接(jie)和(he)支撐,有(you)關部門和(he)三(san)地(di)政府(fu)可聯(lian)合(he)發(fa)(fa)布實施(shi)該《條(tiao)(tiao)例(li)(li)》的(de)(de)辦(ban)(ban)法(fa),如(ru)《京(jing)津(jin)(jin)冀地(di)區(qu)(qu)大(da)(da)氣污(wu)(wu)染(ran)防(fang)(fang)(fang)(fang)治(zhi)(zhi)(zhi)辦(ban)(ban)法(fa)》、《京(jing)津(jin)(jin)冀流域污(wu)(wu)染(ran)聯(lian)動(dong)(dong)防(fang)(fang)(fang)(fang)治(zhi)(zhi)(zhi)辦(ban)(ban)法(fa)》、《京(jing)津(jin)(jin)冀地(di)區(qu)(qu)土(tu)(tu)壤污(wu)(wu)染(ran)防(fang)(fang)(fang)(fang)治(zhi)(zhi)(zhi)辦(ban)(ban)法(fa)》等(deng)。其中《京(jing)津(jin)(jin)冀地(di)區(qu)(qu)大(da)(da)氣污(wu)(wu)染(ran)防(fang)(fang)(fang)(fang)治(zhi)(zhi)(zhi)辦(ban)(ban)法(fa)》應與已(yi)經出臺(tai)的(de)(de)《大(da)(da)氣污(wu)(wu)染(ran)防(fang)(fang)(fang)(fang)治(zhi)(zhi)(zhi)行動(dong)(dong)計劃(hua)》(簡(jian)(jian)稱(cheng)(cheng)“大(da)(da)氣十條(tiao)(tiao)”)、《京(jing)津(jin)(jin)冀及周(zhou)邊地(di)區(qu)(qu)落(luo)實大(da)(da)氣污(wu)(wu)染(ran)防(fang)(fang)(fang)(fang)治(zhi)(zhi)(zhi)行動(dong)(dong)計劃(hua)實施(shi)細則》進行銜(xian)接(jie);《京(jing)津(jin)(jin)冀流域污(wu)(wu)染(ran)聯(lian)動(dong)(dong)防(fang)(fang)(fang)(fang)治(zhi)(zhi)(zhi)辦(ban)(ban)法(fa)》的(de)(de)制(zhi)(zhi)定(ding)須結合(he)即將全面實施(shi)的(de)(de)《水污(wu)(wu)染(ran)防(fang)(fang)(fang)(fang)治(zhi)(zhi)(zhi)行動(dong)(dong)計劃(hua)》(簡(jian)(jian)稱(cheng)(cheng)“水十條(tiao)(tiao)”)。《京(jing)津(jin)(jin)冀地(di)區(qu)(qu)土(tu)(tu)壤污(wu)(wu)染(ran)防(fang)(fang)(fang)(fang)治(zhi)(zhi)(zhi)辦(ban)(ban)法(fa)》應考慮(lv)融合(he)正在制(zhi)(zhi)定(ding)的(de)(de)《土(tu)(tu)壤污(wu)(wu)染(ran)防(fang)(fang)(fang)(fang)治(zhi)(zhi)(zhi)行動(dong)(dong)計劃(hua)》(簡(jian)(jian)稱(cheng)(cheng)“土(tu)(tu)十條(tiao)(tiao)”)。
二、設立“環(huan)境保(bao)護專項工作領(ling)導小組(zu)”,為京津冀環(huan)保(bao)一體化提供法治體制保(bao)障
目前,國家層面已(yi)設(she)置“京(jing)(jing)津(jin)(jin)(jin)(jin)冀(ji)協(xie)(xie)調發展領(ling)導(dao)(dao)小組(zu)(zu)(zu)(zu)”,按照邏輯,其(qi)下應設(she)立“環(huan)(huan)(huan)境(jing)(jing)保(bao)護(hu)專(zhuan)(zhuan)項(xiang)工(gong)(gong)(gong)(gong)作(zuo)領(ling)導(dao)(dao)小組(zu)(zu)(zu)(zu)”,負責京(jing)(jing)津(jin)(jin)(jin)(jin)冀(ji)、長三(san)角(jiao)(jiao)、珠三(san)角(jiao)(jiao)等(deng)(deng)地區(qu)(qu)和(he)(he)流域(yu)(yu)的環(huan)(huan)(huan)境(jing)(jing)治(zhi)(zhi)(zhi)(zhi)(zhi)理工(gong)(gong)(gong)(gong)作(zuo),具體(ti)包括區(qu)(qu)域(yu)(yu)與流域(yu)(yu)的規劃制定(ding)、環(huan)(huan)(huan)境(jing)(jing)監(jian)測和(he)(he)預警應急等(deng)(deng)。在三(san)個地區(qu)(qu)的環(huan)(huan)(huan)境(jing)(jing)共(gong)治(zhi)(zhi)(zhi)(zhi)(zhi)推進(jin)工(gong)(gong)(gong)(gong)作(zuo)中(zhong)(zhong),根據(ju)當前任務的輕(qing)重(zhong)緩急,可優(you)先(xian)開展京(jing)(jing)津(jin)(jin)(jin)(jin)冀(ji)環(huan)(huan)(huan)保(bao)一體(ti)化工(gong)(gong)(gong)(gong)作(zuo),“環(huan)(huan)(huan)境(jing)(jing)保(bao)護(hu)專(zhuan)(zhuan)項(xiang)工(gong)(gong)(gong)(gong)作(zuo)領(ling)導(dao)(dao)小組(zu)(zu)(zu)(zu)”可靈活下設(she):大氣污(wu)染(ran)(ran)防(fang)治(zhi)(zhi)(zhi)(zhi)(zhi)工(gong)(gong)(gong)(gong)作(zuo)組(zu)(zu)(zu)(zu)、流域(yu)(yu)綜合管理工(gong)(gong)(gong)(gong)作(zuo)組(zu)(zu)(zu)(zu)、土壤污(wu)染(ran)(ran)防(fang)治(zhi)(zhi)(zhi)(zhi)(zhi)工(gong)(gong)(gong)(gong)作(zuo)組(zu)(zu)(zu)(zu)等(deng)(deng)。在京(jing)(jing)津(jin)(jin)(jin)(jin)冀(ji)環(huan)(huan)(huan)保(bao)一體(ti)化推進(jin)過程(cheng)中(zhong)(zhong),大氣污(wu)染(ran)(ran)防(fang)治(zhi)(zhi)(zhi)(zhi)(zhi)小組(zu)(zu)(zu)(zu)既需要和(he)(he)環(huan)(huan)(huan)境(jing)(jing)保(bao)護(hu)部污(wu)染(ran)(ran)防(fang)治(zhi)(zhi)(zhi)(zhi)(zhi)司互(hu)有(you)銜接(jie)(jie)(jie),又同時(shi)必須(xu)與京(jing)(jing)津(jin)(jin)(jin)(jin)冀(ji)三(san)地環(huan)(huan)(huan)保(bao)部門建立互(hu)通。目前,北(bei)京(jing)(jing)市(shi)環(huan)(huan)(huan)保(bao)局(ju)(ju)已(yi)成立“京(jing)(jing)津(jin)(jin)(jin)(jin)冀(ji)及周邊地區(qu)(qu)大氣污(wu)染(ran)(ran)防(fang)治(zhi)(zhi)(zhi)(zhi)(zhi)協(xie)(xie)作(zuo)小組(zu)(zu)(zu)(zu)”辦公(gong)室,其(qi)中(zhong)(zhong)“大氣污(wu)染(ran)(ran)綜合治(zhi)(zhi)(zhi)(zhi)(zhi)理協(xie)(xie)調處”受京(jing)(jing)津(jin)(jin)(jin)(jin)冀(ji)及周邊地區(qu)(qu)大氣污(wu)染(ran)(ran)防(fang)治(zhi)(zhi)(zhi)(zhi)(zhi)協(xie)(xie)作(zuo)小組(zu)(zu)(zu)(zu)辦公(gong)室的委托,承(cheng)擔京(jing)(jing)津(jin)(jin)(jin)(jin)冀(ji)及周邊地區(qu)(qu)大氣污(wu)染(ran)(ran)防(fang)治(zhi)(zhi)(zhi)(zhi)(zhi)協(xie)(xie)作(zuo)等(deng)(deng)的具體(ti)聯絡協(xie)(xie)調工(gong)(gong)(gong)(gong)作(zuo)。擬設(she)立的“環(huan)(huan)(huan)境(jing)(jing)保(bao)護(hu)專(zhuan)(zhuan)項(xiang)工(gong)(gong)(gong)(gong)作(zuo)領(ling)導(dao)(dao)小組(zu)(zu)(zu)(zu)”下大氣污(wu)染(ran)(ran)防(fang)治(zhi)(zhi)(zhi)(zhi)(zhi)小組(zu)(zu)(zu)(zu)可與已(yi)成立的北(bei)京(jing)(jing)市(shi)環(huan)(huan)(huan)保(bao)局(ju)(ju)“大氣污(wu)染(ran)(ran)綜合治(zhi)(zhi)(zhi)(zhi)(zhi)理協(xie)(xie)調處”相(xiang)互(hu)對(dui)(dui)接(jie)(jie)(jie)霧霾聯防(fang)聯控(kong)工(gong)(gong)(gong)(gong)作(zuo),這種對(dui)(dui)接(jie)(jie)(jie)可作(zuo)為(wei)先(xian)行示范,為(wei)“環(huan)(huan)(huan)境(jing)(jing)保(bao)護(hu)專(zhuan)(zhuan)項(xiang)工(gong)(gong)(gong)(gong)作(zuo)領(ling)導(dao)(dao)小組(zu)(zu)(zu)(zu)”與天津(jin)(jin)(jin)(jin)、河北(bei)的后續對(dui)(dui)接(jie)(jie)(jie)提供重(zhong)要借鑒,也(ye)為(wei)長三(san)角(jiao)(jiao)、珠三(san)角(jiao)(jiao)等(deng)(deng)地區(qu)(qu)和(he)(he)流域(yu)(yu)的環(huan)(huan)(huan)境(jing)(jing)保(bao)護(hu)、協(xie)(xie)調和(he)(he)監(jian)督工(gong)(gong)(gong)(gong)作(zuo)提供共(gong)治(zhi)(zhi)(zhi)(zhi)(zhi)經驗。
三、建立區域環境共治對接平臺,為(wei)京津(jin)冀環保(bao)一體(ti)化提(ti)供法治機制(zhi)保(bao)障
在政府(fu)主導(dao)的(de)(de)架構下,建立由國家部委、三地政府(fu)、相關企(qi)業(ye)、社會(hui)(hui)組(zu)織(zhi)和個人有序參與(yu)的(de)(de)京津冀環保一體化共(gong)治對接(jie)平臺(tai)(tai)。平臺(tai)(tai)由“環境(jing)保護(hu)(hu)(hu)專(zhuan)(zhuan)項工作(zuo)領導(dao)小組(zu)”主管(guan),通過《條例(li)》約定其工作(zuo)機制(zhi),包括:“環境(jing)保護(hu)(hu)(hu)專(zhuan)(zhuan)項工作(zuo)領導(dao)小組(zu)聯席會(hui)(hui)議”機制(zhi)和“環境(jing)保護(hu)(hu)(hu)社會(hui)(hui)共(gong)治”機制(zhi)。可在環境(jing)保護(hu)(hu)(hu)部官方網站建設(she)“環境(jing)保護(hu)(hu)(hu)專(zhuan)(zhuan)項工作(zuo)領導(dao)小組(zu)”板塊(kuai),其下開設(she)共(gong)治對接(jie)平臺(tai)(tai)子版(ban)塊(kuai)作(zuo)為載體。
(一(yi))建立“環(huan)(huan)(huan)境(jing)保(bao)(bao)護專(zhuan)項(xiang)工(gong)作(zuo)(zuo)(zuo)領導小組(zu)聯席會(hui)(hui)(hui)(hui)(hui)(hui)議”的(de)(de)協調(diao)法(fa)治(zhi)機(ji)(ji)制(zhi)(zhi)。在京津冀(ji)環(huan)(huan)(huan)保(bao)(bao)一(yi)體化推進(jin)工(gong)作(zuo)(zuo)(zuo)中(zhong)(zhong),可(ke)(ke)(ke)率先嘗試“環(huan)(huan)(huan)境(jing)保(bao)(bao)護專(zhuan)項(xiang)工(gong)作(zuo)(zuo)(zuo)領導小組(zu)聯席會(hui)(hui)(hui)(hui)(hui)(hui)議”機(ji)(ji)制(zhi)(zhi),其經驗(yan)可(ke)(ke)(ke)為長三(san)(san)(san)角、珠三(san)(san)(san)角的(de)(de)環(huan)(huan)(huan)保(bao)(bao)共治(zhi)提供示范和(he)參(can)(can)(can)考(kao)(kao)(kao)。第(di)一(yi),會(hui)(hui)(hui)(hui)(hui)(hui)議形(xing)式可(ke)(ke)(ke)采(cai)用(yong)“輪值”模式,在三(san)(san)(san)地(di)(di)輪流舉辦。第(di)二,會(hui)(hui)(hui)(hui)(hui)(hui)議內(nei)容可(ke)(ke)(ke)根據(ju)民(min)(min)眾關心的(de)(de)焦點問題優先設置(zhi)。例如定期(qi)召開霧霾治(zhi)理(li)聯防聯控工(gong)作(zuo)(zuo)(zuo)會(hui)(hui)(hui)(hui)(hui)(hui)議,通(tong)報(bao)(bao)我國(guo)重(zhong)點區域和(he)城市空(kong)氣質量狀況,公(gong)布(bu)階段性治(zhi)理(li)成果,交(jiao)流三(san)(san)(san)地(di)(di)治(zhi)霾策略。第(di)三(san)(san)(san),參(can)(can)(can)會(hui)(hui)(hui)(hui)(hui)(hui)成員應包括各(ge)類機(ji)(ji)構代(dai)表(biao)(biao)。三(san)(san)(san)地(di)(di)的(de)(de)利益相關者都可(ke)(ke)(ke)以在其中(zhong)(zhong)發(fa)揮重(zhong)要作(zuo)(zuo)(zuo)用(yong),聽取民(min)(min)聲,發(fa)揮民(min)(min)長。第(di)四,會(hui)(hui)(hui)(hui)(hui)(hui)議形(xing)式力求(qiu)(qiu)豐(feng)富多樣。會(hui)(hui)(hui)(hui)(hui)(hui)議環(huan)(huan)(huan)節(jie)可(ke)(ke)(ke)包括代(dai)表(biao)(biao)宣講+互動(dong)討(tao)論(lun)+實(shi)地(di)(di)考(kao)(kao)(kao)察(cha)+后(hou)期(qi)反饋(kui)(kui)等(deng)。“代(dai)表(biao)(biao)宣講”一(yi)般是(shi)(shi)參(can)(can)(can)會(hui)(hui)(hui)(hui)(hui)(hui)代(dai)表(biao)(biao)在會(hui)(hui)(hui)(hui)(hui)(hui)場(chang)內(nei)作(zuo)(zuo)(zuo)會(hui)(hui)(hui)(hui)(hui)(hui)議報(bao)(bao)告,融(rong)合(he)(he)多媒體視頻(pin)、音頻(pin)等(deng)手段進(jin)行(xing)全方位展現(xian)。“互動(dong)討(tao)論(lun)”可(ke)(ke)(ke)采(cai)取頭(tou)腦風暴模式,鼓勵代(dai)表(biao)(biao)積極發(fa)言。“實(shi)地(di)(di)考(kao)(kao)(kao)察(cha)”是(shi)(shi)力求(qiu)(qiu)讓參(can)(can)(can)會(hui)(hui)(hui)(hui)(hui)(hui)代(dai)表(biao)(biao)獲得(de)直觀的(de)(de)感性認(ren)識,可(ke)(ke)(ke)針(zhen)對污染河段進(jin)行(xing)場(chang)地(di)(di)踏(ta)勘,到“三(san)(san)(san)高”企業了解節(jie)能減排工(gong)藝(yi)流程等(deng)。“后(hou)期(qi)反饋(kui)(kui)”是(shi)(shi)對參(can)(can)(can)會(hui)(hui)(hui)(hui)(hui)(hui)代(dai)表(biao)(biao)進(jin)行(xing)會(hui)(hui)(hui)(hui)(hui)(hui)后(hou)跟(gen)蹤回訪,收集意見及建議,及時(shi)反饋(kui)(kui)到“環(huan)(huan)(huan)境(jing)保(bao)(bao)護專(zhuan)項(xiang)工(gong)作(zuo)(zuo)(zuo)領導小組(zu)”相關部門進(jin)行(xing)匯總(zong)提煉,作(zuo)(zuo)(zuo)為下次擬定會(hui)(hui)(hui)(hui)(hui)(hui)議議程的(de)(de)重(zhong)要參(can)(can)(can)考(kao)(kao)(kao)。四個環(huan)(huan)(huan)節(jie)互為補充,相得(de)益彰(zhang),使“環(huan)(huan)(huan)境(jing)保(bao)(bao)護專(zhuan)項(xiang)工(gong)作(zuo)(zuo)(zuo)領導小組(zu)會(hui)(hui)(hui)(hui)(hui)(hui)議”機(ji)(ji)制(zhi)(zhi)真正發(fa)揮綜(zong)合(he)(he)統籌的(de)(de)作(zuo)(zuo)(zuo)用(yong)。
(二)建(jian)(jian)立“環(huan)境(jing)(jing)保護社會(hui)共(gong)治”法治機制(zhi)。建(jian)(jian)立“環(huan)境(jing)(jing)保護社會(hui)共(gong)治”機制(zhi),其成(cheng)員應包括利益(yi)相(xiang)關(guan)方代(dai)表,如京(jing)津冀(ji)三地(di)的(de)(de)(de)政府(fu)官員、企業職工(gong)、NGO組(zu)織(zhi)成(cheng)員、社區居民等。基于(yu)目前我(wo)國社會(hui)組(zu)織(zhi)發展還(huan)不(bu)健全的(de)(de)(de)現狀,可以考慮(lv)讓政府(fu)發起,各(ge)類機構在不(bu)同(tong)領域,從(cong)不(bu)同(tong)程度逐步參(can)與到京(jing)津冀(ji)環(huan)境(jing)(jing)保護共(gong)治工(gong)作中(zhong)來。如企業對環(huan)保產業及(ji)(ji)綠色投資的(de)(de)(de)管理(li)決策、居民生活方式(shi)向低(di)碳化的(de)(de)(de)轉變、召集代(dai)表參(can)會(hui)表達意見及(ji)(ji)共(gong)同(tong)監督政策制(zhi)定過程等。各(ge)類主體廣泛參(can)與,積極(ji)互動(dong),有利于(yu)克服單一部門(men)權(quan)力擴張(zhang)、視野狹窄的(de)(de)(de)弊端,有利于(yu)統籌利益(yi)相(xiang)關(guan)方的(de)(de)(de)權(quan)責平衡,最(zui)大(da)限度地(di)發揮監督、制(zhi)約(yue)及(ji)(ji)共(gong)贏的(de)(de)(de)力量。
