將信用評價與經濟政策有機融合
積極運用(yong)(yong)價(jia)格(ge)手(shou)段,根據(ju)企業(ye)環(huan)(huan)保信用(yong)(yong)評價(jia)等級實行(xing)差別電(dian)價(jia)、差別收取污(wu)水處理費兩項環(huan)(huan)境(jing)(jing)經濟新政。這(zhe)是(shi)江蘇(su)省環(huan)(huan)保廳對(dui)高(gao)污(wu)染企業(ye)生產經營(ying)活動事(shi)中事(shi)后監管方(fang)式的(de)大膽創新,是(shi)對(dui)環(huan)(huan)境(jing)(jing)經濟政策(ce)的(de)有益探索。
江(jiang)蘇(su)省(sheng)(sheng)各級(ji)環(huan)(huan)保(bao)(bao)(bao)部門按照省(sheng)(sheng)《企(qi)業(ye)環(huan)(huan)保(bao)(bao)(bao)信(xin)(xin)(xin)用評價(jia)標(biao)(biao)準及評價(jia)方法》,根據企(qi)業(ye)建(jian)設項目環(huan)(huan)保(bao)(bao)(bao)審批、排(pai)(pai)污(wu)口規(gui)范(fan)化管理(li)(li)、污(wu)染物(wu)排(pai)(pai)放達標(biao)(biao)和(he)總量控制(zhi)、污(wu)染源在線監(jian)測、排(pai)(pai)污(wu)申報和(he)排(pai)(pai)污(wu)費繳納、污(wu)染治理(li)(li)設施運行、清潔生產(chan)、環(huan)(huan)境(jing)信(xin)(xin)(xin)訪投訴、環(huan)(huan)保(bao)(bao)(bao)行政(zheng)處罰、突發(fa)環(huan)(huan)境(jing)事件、環(huan)(huan)境(jing)污(wu)染責任保(bao)(bao)(bao)險等(deng)(deng)21個方面情況,每年對(dui)占全省(sheng)(sheng)排(pai)(pai)污(wu)總量90%以上的2.3萬多家重點污(wu)染源企(qi)業(ye)的環(huan)(huan)保(bao)(bao)(bao)信(xin)(xin)(xin)用作出評價(jia)。信(xin)(xin)(xin)用等(deng)(deng)級(ji)從高到低(di)按綠、藍(lan)、黃、紅(hong)、黑(hei)(hei)5色排(pai)(pai)序(xu)。綠色企(qi)業(ye)環(huan)(huan)保(bao)(bao)(bao)信(xin)(xin)(xin)用等(deng)(deng)級(ji)最(zui)高,黑(hei)(hei)色企(qi)業(ye)環(huan)(huan)保(bao)(bao)(bao)信(xin)(xin)(xin)用等(deng)(deng)級(ji)最(zui)低(di)。評價(jia)結(jie)果推送到省(sheng)(sheng)公(gong)共信(xin)(xin)(xin)用信(xin)(xin)(xin)息平臺(tai),與(yu)物(wu)價(jia)、財政(zheng)、發(fa)改、經信(xin)(xin)(xin)、住建(jian)、水(shui)利(li)、科(ke)技、商務(wu)、安監(jian)、國(guo)資、工(gong)商、稅務(wu)、銀監(jian)、證監(jian)、保(bao)(bao)(bao)監(jian)、銀行業(ye)金融機(ji)構等(deng)(deng)政(zheng)府部門和(he)市場監(jian)管機(ji)構共享,并向社會(hui)公(gong)開。
在此基礎上(shang),江蘇(su)(su)省(sheng)(sheng)環(huan)(huan)(huan)保(bao)廳(ting)(ting)聯合省(sheng)(sheng)物價(jia)(jia)(jia)局(ju)出臺《關(guan)于(yu)根據環(huan)(huan)(huan)保(bao)信用評(ping)(ping)價(jia)(jia)(jia)等(deng)級(ji)試行差(cha)別(bie)電(dian)(dian)價(jia)(jia)(jia)有(you)關(guan)問題的(de)通(tong)知》規定(ding),對(dui)(dui)年度環(huan)(huan)(huan)保(bao)信用評(ping)(ping)價(jia)(jia)(jia)結果為(wei)紅色(se)、黑色(se)等(deng)級(ji)的(de)高污(wu)染企(qi)業(ye)實行電(dian)(dian)價(jia)(jia)(jia)加(jia)(jia)價(jia)(jia)(jia)政策。其中對(dui)(dui)紅色(se)等(deng)級(ji)企(qi)業(ye),用電(dian)(dian)價(jia)(jia)(jia)格每(mei)千瓦時(shi)(shi)加(jia)(jia)價(jia)(jia)(jia)0.05元;對(dui)(dui)黑色(se)等(deng)級(ji)企(qi)業(ye),用電(dian)(dian)價(jia)(jia)(jia)格每(mei)千瓦時(shi)(shi)加(jia)(jia)價(jia)(jia)(jia)0.10元。同(tong)時(shi)(shi),江蘇(su)(su)省(sheng)(sheng)環(huan)(huan)(huan)保(bao)廳(ting)(ting)聯合省(sheng)(sheng)財政廳(ting)(ting)、省(sheng)(sheng)物價(jia)(jia)(jia)局(ju)、省(sheng)(sheng)住建(jian)廳(ting)(ting)、省(sheng)(sheng)水利廳(ting)(ting)出臺的(de)《關(guan)于(yu)印發江蘇(su)(su)省(sheng)(sheng)污(wu)水處(chu)理費征收使用管(guan)理實施辦法的(de)通(tong)知》規定(ding),對(dui)(dui)環(huan)(huan)(huan)保(bao)信用評(ping)(ping)價(jia)(jia)(jia)等(deng)級(ji)為(wei)紅色(se)的(de)企(qi)業(ye),污(wu)水處(chu)理費加(jia)(jia)收標準不(bu)低(di)于(yu)0.6元/立(li)方米(mi);對(dui)(dui)黑色(se)等(deng)級(ji)及連續兩(liang)次以(yi)上(shang)被評(ping)(ping)為(wei)紅色(se)等(deng)級(ji)的(de)企(qi)業(ye),污(wu)水處(chu)理費加(jia)(jia)收標準不(bu)低(di)于(yu)1.0元/立(li)方米(mi)。
企(qi)業(ye)生產經(jing)營總要用(yong)水(shui)、用(yong)電,紅色(se)(se)、黑(hei)色(se)(se)等(deng)級(ji)的(de)(de)(de)高污染企(qi)業(ye)要比環(huan)(huan)(huan)保(bao)信用(yong)好的(de)(de)(de)綠色(se)(se)、藍色(se)(se)企(qi)業(ye)多(duo)付出(chu)經(jing)營成本。日積月(yue)累,增加(jia)的(de)(de)(de)費(fei)用(yong)將遠(yuan)遠(yuan)高于(yu)一(yi)般的(de)(de)(de)行政(zheng)處(chu)罰金(jin)額。紅色(se)(se)、黑(hei)色(se)(se)企(qi)業(ye)必然面(mian)臨(lin)3種抉擇。一(yi)是(shi)(shi)由于(yu)成本增加(jia),導致在市(shi)場(chang)中失去競爭力,關(guan)門了事;二是(shi)(shi)為了不被(bei)市(shi)場(chang)淘汰,加(jia)大環(huan)(huan)(huan)保(bao)資金(jin)投入,進行技改、完善(shan)污染治理設施(shi),實(shi)現鳳凰涅槃(pan)轉型(xing)升級(ji);三是(shi)(shi)認真(zhen)改正環(huan)(huan)(huan)境違法行為,老老實(shi)實(shi)遵守環(huan)(huan)(huan)保(bao)法律法規標準(zhun)政(zheng)策,修復(fu)、提高企(qi)業(ye)的(de)(de)(de)環(huan)(huan)(huan)保(bao)信用(yong)等(deng)級(ji)。這3種情形可(ke)謂殊途同歸(gui),都帶來一(yi)種環(huan)(huan)(huan)境友(you)好的(de)(de)(de)結果,即減少污染物排(pai)放,改善(shan)環(huan)(huan)(huan)境質量。
當前(qian),各地對企(qi)業的(de)環(huan)(huan)境監管與(yu)(yu)信用(yong)評價普遍存在兩個問題(ti)(ti)。一是(shi)不(bu)夠重視。環(huan)(huan)保(bao)工作過于(yu)倚(yi)重行政(zheng)(zheng)(zheng)手(shou)段(duan)(duan),尚(shang)未實(shi)(shi)現(xian)預(yu)期的(de)歷史性轉(zhuan)(zhuan)變(bian)(bian)。早在2006年召開的(de)第六次全(quan)國環(huan)(huan)保(bao)大(da)會就明確提出(chu)要加快實(shi)(shi)現(xian)環(huan)(huan)境保(bao)護三個轉(zhuan)(zhuan)變(bian)(bian),其中之(zhi)一就是(shi)從主(zhu)要用(yong)行政(zheng)(zheng)(zheng)辦法保(bao)護環(huan)(huan)境向綜合運用(yong)法律、經濟、技術和必要的(de)行政(zheng)(zheng)(zheng)辦法解決(jue)環(huan)(huan)境問題(ti)(ti)轉(zhuan)(zhuan)變(bian)(bian)。但各地實(shi)(shi)踐中仍然(ran)感到行政(zheng)(zheng)(zheng)手(shou)段(duan)(duan)如(ru)行政(zheng)(zheng)(zheng)處罰、行政(zheng)(zheng)(zheng)命令等易立(li)刻見(jian)效,往往忽視經濟手(shou)段(duan)(duan)如(ru)價格手(shou)段(duan)(duan)的(de)運用(yong),甚(shen)至認(ren)為運用(yong)經濟政(zheng)(zheng)(zheng)策(ce)是(shi)經濟主(zhu)管部門的(de)事,與(yu)(yu)環(huan)(huan)保(bao)部門無關。
二是不會用(yong)。企業(ye)(ye)環(huan)保(bao)(bao)信(xin)(xin)用(yong)評(ping)(ping)(ping)價(jia)(jia)結果(guo)(guo)(guo)沒(mei)(mei)有(you)與(yu)其(qi)(qi)他(ta)部(bu)(bu)門(men)(men)共(gong)用(yong)共(gong)享(xiang),沒(mei)(mei)有(you)充分(fen)發(fa)揮(hui)評(ping)(ping)(ping)價(jia)(jia)結果(guo)(guo)(guo)促(cu)進企業(ye)(ye)改(gai)善環(huan)境(jing)行為的(de)(de)(de)(de)應有(you)作用(yong)。近年(nian)來,環(huan)境(jing)保(bao)(bao)護(hu)(hu)部(bu)(bu)先后會同國(guo)家發(fa)改(gai)委(wei)、人民銀(yin)行、銀(yin)監會等(deng)(deng)有(you)關(guan)(guan)部(bu)(bu)門(men)(men)出臺了《企業(ye)(ye)環(huan)保(bao)(bao)信(xin)(xin)用(yong)評(ping)(ping)(ping)價(jia)(jia)辦(ban)法(試行)》、《關(guan)(guan)于加強企業(ye)(ye)環(huan)保(bao)(bao)信(xin)(xin)用(yong)體系建設(she)的(de)(de)(de)(de)指導意見》,要(yao)求各(ge)地聯合構建環(huan)境(jing)保(bao)(bao)護(hu)(hu)守信(xin)(xin)激勵、失(shi)信(xin)(xin)懲戒的(de)(de)(de)(de)機制。但(dan)在實踐中,不少(shao)地方仍存在環(huan)保(bao)(bao)信(xin)(xin)用(yong)評(ping)(ping)(ping)價(jia)(jia)參評(ping)(ping)(ping)企業(ye)(ye)覆(fu)蓋面過窄、評(ping)(ping)(ping)價(jia)(jia)結果(guo)(guo)(guo)沒(mei)(mei)有(you)與(yu)其(qi)(qi)他(ta)部(bu)(bu)門(men)(men)共(gong)用(yong)共(gong)享(xiang)等(deng)(deng)問題(ti)。有(you)的(de)(de)(de)(de)環(huan)保(bao)(bao)人甚至(zhi)認為,環(huan)保(bao)(bao)部(bu)(bu)門(men)(men)辛辛苦苦評(ping)(ping)(ping)出來的(de)(de)(de)(de)結果(guo)(guo)(guo),為什么要(yao)無償(chang)讓別的(de)(de)(de)(de)部(bu)(bu)門(men)(men)共(gong)享(xiang)?不僅不推動(dong)(dong)其(qi)(qi)他(ta)部(bu)(bu)門(men)(men)運用(yong),當其(qi)(qi)他(ta)部(bu)(bu)門(men)(men)主動(dong)(dong)要(yao)求運用(yong)評(ping)(ping)(ping)價(jia)(jia)結果(guo)(guo)(guo)時(shi)還設(she)置障礙。企業(ye)(ye)環(huan)保(bao)(bao)信(xin)(xin)用(yong)信(xin)(xin)息多部(bu)(bu)門(men)(men)共(gong)用(yong)共(gong)享(xiang)、聯合獎懲的(de)(de)(de)(de)機制沒(mei)(mei)有(you)建立起來,限制了評(ping)(ping)(ping)價(jia)(jia)結果(guo)(guo)(guo)作用(yong)的(de)(de)(de)(de)發(fa)揮(hui)。
創新環(huan)境監管方式,使信(xin)用(yong)與價格兩項政(zheng)策聯手發(fa)力,促(cu)進企業環(huan)境守法,必須(xu)做(zuo)好以(yi)下3個方面:
第(di)一(yi),敞開企業(ye)環(huan)(huan)保(bao)(bao)信用(yong)(yong)評(ping)價的(de)(de)大(da)門(men),推動(dong)物價等(deng)(deng)多部門(men)共(gong)(gong)用(yong)(yong)共(gong)(gong)享評(ping)價結果。環(huan)(huan)保(bao)(bao)信用(yong)(yong)體系(xi)建設,是(shi)一(yi)種環(huan)(huan)境(jing)(jing)管理制(zhi)(zhi)度的(de)(de)創新,是(shi)一(yi)種環(huan)(huan)境(jing)(jing)監(jian)管的(de)(de)綜合(he)手段。進行(xing)企業(ye)環(huan)(huan)保(bao)(bao)信用(yong)(yong)評(ping)價,運(yun)用(yong)(yong)評(ping)價結果,不能環(huan)(huan)保(bao)(bao)一(yi)家單打獨斗。要(yao)加強(qiang)與有關(guan)部門(men)的(de)(de)聯動(dong)配合(he),緊緊依靠政府(fu)經濟(ji)管理部門(men)、市場監(jian)管部門(men)和(he)銀(yin)行(xing)業(ye)金融(rong)機(ji)構及(ji)其監(jian)管部門(men)。通過環(huan)(huan)保(bao)(bao)信用(yong)(yong)信息的(de)(de)交(jiao)換(huan)與共(gong)(gong)享,建立健全企業(ye)環(huan)(huan)保(bao)(bao)信用(yong)(yong)共(gong)(gong)用(yong)(yong)共(gong)(gong)享機(ji)制(zhi)(zhi)。推動(dong)相關(guan)部門(men)和(he)協會在行(xing)政許可、公共(gong)(gong)采購、評(ping)先創優、金融(rong)支持、資質等(deng)(deng)級評(ping)定、安排和(he)撥付財政補貼專項(xiang)資金中運(yun)用(yong)(yong)評(ping)價結果。優先安排環(huan)(huan)境(jing)(jing)誠信的(de)(de)綠色、藍色企業(ye),從嚴(yan)限制(zhi)(zhi)環(huan)(huan)境(jing)(jing)失信的(de)(de)紅(hong)色、黑色企業(ye),實現聯動(dong)激勵(li)與懲戒,放大(da)評(ping)價效應,引導和(he)倒逼(bi)企業(ye)環(huan)(huan)境(jing)(jing)守法(fa)、綠色發展(zhan)。
第二,充分認清價(jia)格杠(gang)(gang)桿(gan)的(de)作(zuo)用(yong)(yong)(yong),積極運用(yong)(yong)(yong)價(jia)格杠(gang)(gang)桿(gan)。價(jia)格是市場(chang)機制(zhi)的(de)核(he)心(xin),是市場(chang)經濟條件下調節利益分配最靈敏、最有效的(de)杠(gang)(gang)桿(gan)。價(jia)格扶(fu)持(chi)政(zheng)(zheng)策(ce)具(ju)有激(ji)勵作(zuo)用(yong)(yong)(yong)、價(jia)費優(you)惠政(zheng)(zheng)策(ce)具(ju)有引導作(zuo)用(yong)(yong)(yong)、差(cha)別價(jia)費政(zheng)(zheng)策(ce)具(ju)有倒(dao)逼作(zuo)用(yong)(yong)(yong),價(jia)格杠(gang)(gang)桿(gan)在推(tui)動(dong)環(huan)境保(bao)護(hu)、服務生態文明建設方面具(ju)有獨特的(de)優(you)勢。通(tong)過(guo)(guo)價(jia)格政(zheng)(zheng)策(ce)的(de)扶(fu)持(chi)作(zuo)用(yong)(yong)(yong),鼓勵企(qi)業(ye)(ye)(ye)加大(da)環(huan)保(bao)投入,提(ti)高(gao)資源使(shi)用(yong)(yong)(yong)效率,減少污(wu)染排(pai)放,引導社會資源流向環(huan)境守法企(qi)業(ye)(ye)(ye),增強其競爭優(you)勢,形(xing)成鮮明的(de)激(ji)勵效應、示范效應和政(zheng)(zheng)策(ce)導向效應。通(tong)過(guo)(guo)加大(da)差(cha)別水電(dian)價(jia)、懲罰(fa)性(xing)(xing)水電(dian)價(jia)政(zheng)(zheng)策(ce)的(de)實施(shi)力(li)度,抑制(zhi)高(gao)耗能(neng)(neng)高(gao)污(wu)染行業(ye)(ye)(ye)盲目發展(zhan)、低水平重復建設,通(tong)過(guo)(guo)對落(luo)后(hou)產業(ye)(ye)(ye)和產能(neng)(neng)、環(huan)境失信企(qi)業(ye)(ye)(ye)實施(shi)懲罰(fa)性(xing)(xing)價(jia)費政(zheng)(zheng)策(ce),加速產業(ye)(ye)(ye)轉型、淘汰落(luo)后(hou)產能(neng)(neng),推(tui)動(dong)供給側(ce)結構性(xing)(xing)改革(ge)。
第(di)三(san),科學把(ba)握將(jiang)環保(bao)信(xin)用(yong)融(rong)入價(jia)(jia)格(ge)(ge)(ge)(ge)杠桿(gan)推(tui)進(jin)環境(jing)(jing)(jing)保(bao)護的(de)(de)基本(ben)原則(ze)。堅(jian)持市場(chang)驅動(dong)與政(zheng)府(fu)推(tui)動(dong)相(xiang)結合。發揮市場(chang)在資(zi)源配置中的(de)(de)決(jue)定性(xing)(xing)作用(yong),通過價(jia)(jia)格(ge)(ge)(ge)(ge)機(ji)(ji)制(zhi)(zhi)(zhi)影響(xiang)供(gong)求機(ji)(ji)制(zhi)(zhi)(zhi)、競(jing)爭機(ji)(ji)制(zhi)(zhi)(zhi),把(ba)價(jia)(jia)格(ge)(ge)(ge)(ge)改(gai)(gai)(gai)革(ge)(ge)調整建立(li)在充分(fen)(fen)尊(zun)重(zhong)價(jia)(jia)值(zhi)規(gui)律、市場(chang)規(gui)律、環保(bao)規(gui)律的(de)(de)基礎上。完善促進(jin)環境(jing)(jing)(jing)保(bao)護的(de)(de)價(jia)(jia)格(ge)(ge)(ge)(ge)政(zheng)策和相(xiang)關(guan)法律法規(gui)、規(gui)章制(zhi)(zhi)(zhi)度(du),合理(li)(li)確定政(zheng)府(fu)定價(jia)(jia)、政(zheng)府(fu)指導價(jia)(jia),加強對(dui)(dui)企(qi)(qi)業(ye)(ye)環境(jing)(jing)(jing)行為、市場(chang)價(jia)(jia)格(ge)(ge)(ge)(ge)行為的(de)(de)監管。堅(jian)持突出重(zhong)點與整體推(tui)進(jin)相(xiang)結合。對(dui)(dui)不(bu)同環保(bao)信(xin)用(yong)等級的(de)(de)企(qi)(qi)業(ye)(ye)實行價(jia)(jia)格(ge)(ge)(ge)(ge)政(zheng)策分(fen)(fen)類管理(li)(li),重(zhong)點抓“兩頭(tou)”。對(dui)(dui)環保(bao)信(xin)用(yong)等級差的(de)(de)企(qi)(qi)業(ye)(ye)實施懲罰性(xing)(xing)收(shou)費,遠期還(huan)應對(dui)(dui)環保(bao)信(xin)用(yong)等級好的(de)(de)綠色企(qi)(qi)業(ye)(ye)推(tui)出價(jia)(jia)格(ge)(ge)(ge)(ge)優惠或收(shou)費減免(mian)政(zheng)策。堅(jian)持積(ji)極穩妥和扎實推(tui)進(jin)相(xiang)結合。統(tong)籌(chou)兼顧環保(bao)信(xin)用(yong)運用(yong)于價(jia)(jia)格(ge)(ge)(ge)(ge)改(gai)(gai)(gai)革(ge)(ge)對(dui)(dui)不(bu)同地區、不(bu)同群體、不(bu)同行業(ye)(ye)的(de)(de)利益(yi)影響(xiang),審(shen)慎權衡改(gai)(gai)(gai)革(ge)(ge)的(de)(de)速度(du)、力度(du)與社會對(dui)(dui)改(gai)(gai)(gai)革(ge)(ge)的(de)(de)可接(jie)受程度(du),合理(li)(li)分(fen)(fen)擔改(gai)(gai)(gai)革(ge)(ge)成(cheng)本(ben)、分(fen)(fen)配改(gai)(gai)(gai)革(ge)(ge)收(shou)益(yi),使這(zhe)項價(jia)(jia)格(ge)(ge)(ge)(ge)改(gai)(gai)(gai)革(ge)(ge)成(cheng)為社會的(de)(de)穩定器和供(gong)給側結構性(xing)(xing)改(gai)(gai)(gai)革(ge)(ge)與綠色發展的(de)(de)助推(tui)器。
