廣西強化危險廢物監管和利用處置能力改革實施方案
為貫(guan)徹落實《國(guo)務院辦(ban)公(gong)廳關于(yu)印發(fa)強化(hua)危險廢(fei)(fei)物(wu)監管(guan)和利用(yong)處置能力改革實施方(fang)案的(de)通知》(國(guo)辦(ban)函〔2021〕47號)精神,進(jin)一步(bu)提升我區危險廢(fei)(fei)物(wu)監管(guan)和利用(yong)處置能力,有效防控危險廢(fei)(fei)物(wu)環境與(yu)安全風險,結(jie)合我區實際,制定本方(fang)案。
一、總體要求
(一(yi))工(gong)作思(si)路。以(yi)(yi)習(xi)近平(ping)新時代(dai)中(zhong)國(guo)特色社會(hui)(hui)主義思(si)想(xiang)(xiang)為指導,全(quan)(quan)面貫(guan)徹(che)黨(dang)的十九大和(he)十九屆二中(zhong)、三中(zhong)、四中(zhong)、五中(zhong)全(quan)(quan)會(hui)(hui)精神(shen)(shen),深入貫(guan)徹(che)落實習(xi)近平(ping)生(sheng)態文明思(si)想(xiang)(xiang)和(he)習(xi)近平(ping)總書記對(dui)廣西工(gong)作系(xi)列重(zhong)要指示精神(shen)(shen),按照(zhao)黨(dang)中(zhong)央、國(guo)務院決策(ce)部署和(he)自治(zhi)(zhi)(zhi)區黨(dang)委、自治(zhi)(zhi)(zhi)區人(ren)民政府要求,堅持(chi)(chi)精準治(zhi)(zhi)(zhi)污(wu)(wu)(wu)、科學治(zhi)(zhi)(zhi)污(wu)(wu)(wu)、依(yi)法治(zhi)(zhi)(zhi)污(wu)(wu)(wu),以(yi)(yi)持(chi)(chi)續改(gai)善生(sheng)態環(huan)境(jing)質量為核心,以(yi)(yi)有(you)效防控(kong)危險廢物環(huan)境(jing)污(wu)(wu)(wu)染與安全(quan)(quan)風險為底線,深化體制(zhi)機制(zhi)改(gai)革,著力提升危險廢物監管(guan)和(he)利用(yong)處置能力,切實維護人(ren)民群(qun)眾身體健康和(he)生(sheng)態環(huan)境(jing)安全(quan)(quan)。
(二)工作目標。到2022年底(di),危(wei)險廢(fei)物(wu)(wu)監管(guan)體制(zhi)機制(zhi)進一(yi)步完善,建立安(an)全(quan)監管(guan)與環(huan)境監管(guan)聯動機制(zhi);危(wei)險廢(fei)物(wu)(wu)非法轉(zhuan)移傾倒(dao)案件高發態勢(shi)得到有效遏制(zhi)。基(ji)本(ben)補齊(qi)醫療(liao)廢(fei)物(wu)(wu)、危(wei)險廢(fei)物(wu)(wu)收(shou)集(ji)處理設施短板,全(quan)區縣(xian)級以上(shang)(shang)城市建成區醫療(liao)廢(fei)物(wu)(wu)無(wu)害化處置(zhi)率達到99%以上(shang)(shang),危(wei)險廢(fei)物(wu)(wu)處置(zhi)能力基(ji)本(ben)滿足全(quan)區處置(zhi)需求。
到2025年(nian)底,建立健全源頭(tou)嚴防、過程嚴管、后(hou)果(guo)嚴懲(cheng)的危險廢物(wu)監管體系(xi)。危險廢物(wu)利用處置(zhi)能力充分保障,技(ji)術和(he)運營(ying)水平進一步提升。
二、完善(shan)危險(xian)廢物監(jian)管體(ti)制機(ji)制
(三)依法依規履行危險(xian)廢物(wu)監管(guan)職責(ze)。全(quan)區(qu)各(ge)級(ji)人民政(zheng)(zheng)府(fu)對(dui)本(ben)轄區(qu)危險(xian)廢物(wu)治理負總(zong)責(ze)。各(ge)級(ji)發(fa)展改(gai)革、工業和(he)(he)信息(xi)化(hua)、生(sheng)(sheng)態(tai)環(huan)境(jing)、應急、公(gong)安(an)(an)、交(jiao)通運(yun)輸(shu)、衛生(sheng)(sheng)健(jian)康、住(zhu)(zhu)房(fang)城鄉建設、海(hai)(hai)關(guan)、海(hai)(hai)事等有關(guan)部門要(yao)落實在危險(xian)廢物(wu)利用(yong)處(chu)置、污(wu)染環(huan)境(jing)防(fang)治、安(an)(an)全(quan)生(sheng)(sheng)產(chan)、運(yun)輸(shu)安(an)(an)全(quan)以及衛生(sheng)(sheng)防(fang)疫等方面的監管(guan)職責(ze),強化(hua)部門間協調(diao)溝通,形(xing)成(cheng)工作合(he)力,推(tui)進我區(qu)危險(xian)廢物(wu)治理體系和(he)(he)治理能(neng)力現代化(hua)。(自(zi)治區(qu)生(sheng)(sheng)態(tai)環(huan)境(jing)廳(ting)、發(fa)展改(gai)革委(wei)(wei)、工業和(he)(he)信息(xi)化(hua)廳(ting)、公(gong)安(an)(an)廳(ting)、住(zhu)(zhu)房(fang)城鄉建設廳(ting)、交(jiao)通運(yun)輸(shu)廳(ting)、衛生(sheng)(sheng)健(jian)康委(wei)(wei)、應急廳(ting),南寧海(hai)(hai)關(guan)、廣西海(hai)(hai)事局等部門及全(quan)區(qu)各(ge)級(ji)人民政(zheng)(zheng)府(fu)負責(ze)落實。以下均需全(quan)區(qu)各(ge)級(ji)人民政(zheng)(zheng)府(fu)負責(ze)落實,不再列出)
(四)深化危險(xian)(xian)廢物(wu)(wu)環(huan)境風險(xian)(xian)區域聯(lian)防(fang)(fang)(fang)聯(lian)控(kong)機制。落實《粵桂危險(xian)(xian)廢物(wu)(wu)跨省(sheng)非(fei)法轉移聯(lian)防(fang)(fang)(fang)聯(lian)控(kong)合(he)作協(xie)議》和(he)《福建(jian)、江(jiang)西(xi)(xi)(xi)、湖(hu)南(nan)、廣(guang)東、廣(guang)西(xi)(xi)(xi)五省(sheng)(區)危險(xian)(xian)廢物(wu)(wu)跨省(sheng)非(fei)法轉移聯(lian)防(fang)(fang)(fang)聯(lian)控(kong)合(he)作協(xie)議》,加強(qiang)危險(xian)(xian)廢物(wu)(wu)管(guan)理(li)信息共享與(yu)聯(lian)動(dong)執法,提升聯(lian)防(fang)(fang)(fang)聯(lian)控(kong)合(he)力(li),嚴厲打擊(ji)跨省(sheng)非(fei)法轉移、傾倒、處(chu)置(zhi)危險(xian)(xian)廢物(wu)(wu)等環(huan)境違法行(xing)為,實現危險(xian)(xian)廢物(wu)(wu)集中處(chu)置(zhi)設施(shi)建(jian)設和(he)運(yun)(yun)營管(guan)理(li)的(de)優勢互補。(自治區生(sheng)態環(huan)境廳牽頭(tou),自治區公安廳、交(jiao)通(tong)運(yun)(yun)輸廳,廣(guang)西(xi)(xi)(xi)海事(shi)局(ju)等部(bu)門參與(yu))
(五)落實(shi)涉危(wei)險(xian)(xian)廢(fei)(fei)物(wu)(wu)企(qi)業(ye)(ye)(ye)的主體責(ze)(ze)任(ren)。督(du)促危(wei)險(xian)(xian)廢(fei)(fei)物(wu)(wu)產生、收集、貯存(cun)、運輸、利用、處置企(qi)業(ye)(ye)(ye)(以下統稱(cheng)危(wei)險(xian)(xian)廢(fei)(fei)物(wu)(wu)相關企(qi)業(ye)(ye)(ye))的主要負責(ze)(ze)人(法(fa)定(ding)代表人、實(shi)際(ji)控制(zhi)人)履行(xing)危(wei)險(xian)(xian)廢(fei)(fei)物(wu)(wu)污染環(huan)境(jing)防(fang)治和(he)安(an)(an)全生產第一責(ze)(ze)任(ren)人職責(ze)(ze),嚴格(ge)落實(shi)危(wei)險(xian)(xian)廢(fei)(fei)物(wu)(wu)污染環(huan)境(jing)防(fang)治和(he)安(an)(an)全生產法(fa)律法(fa)規制(zhi)度。(自治區生態環(huan)境(jing)廳(ting)、公安(an)(an)廳(ting)、交通運輸廳(ting)、應急廳(ting),廣(guang)西(xi)海(hai)事局(ju)等部門按(an)職責(ze)(ze)分(fen)工負責(ze)(ze))危(wei)險(xian)(xian)廢(fei)(fei)物(wu)(wu)相關企(qi)業(ye)(ye)(ye)依(yi)法(fa)及時(shi)公開危(wei)險(xian)(xian)廢(fei)(fei)物(wu)(wu)污染環(huan)境(jing)防(fang)治信息,依(yi)法(fa)依(yi)規投(tou)保環(huan)境(jing)污染責(ze)(ze)任(ren)保險(xian)(xian)。(自治區生態環(huan)境(jing)廳(ting)、廣(guang)西(xi)銀保監局(ju)等部門按(an)職責(ze)(ze)分(fen)工負責(ze)(ze))
(六(liu))完善(shan)危險(xian)廢物(wu)(wu)環境(jing)管理(li)(li)(li)信息化(hua)體系(xi)。全面升級廣西(xi)固體廢物(wu)(wu)管理(li)(li)(li)系(xi)統,實(shi)現危險(xian)廢物(wu)(wu)產(chan)生(sheng)單(dan)(dan)(dan)位(wei)在(zai)線(xian)申報登記、管理(li)(li)(li)計劃在(zai)線(xian)備(bei)案,危險(xian)廢物(wu)(wu)經(jing)營單(dan)(dan)(dan)位(wei)出入(ru)庫全程管理(li)(li)(li)、利用(yong)處置(zhi)情況在(zai)線(xian)填報,優化(hua)危險(xian)廢物(wu)(wu)跨省轉移審批、危險(xian)廢物(wu)(wu)轉移電(dian)子聯單(dan)(dan)(dan)在(zai)線(xian)運(yun)行(xing)等(deng)(deng)功(gong)能。探索開展(zhan)危險(xian)廢物(wu)(wu)收集(ji)(ji)、運(yun)輸、利用(yong)、處置(zhi)網(wang)上交(jiao)易(yi)平臺建設和第三方支付試點(dian)。探索推行(xing)視(shi)頻監(jian)控(kong)、電(dian)子標簽等(deng)(deng)集(ji)(ji)成智能監(jian)控(kong)手段,實(shi)現對危險(xian)廢物(wu)(wu)全過程跟(gen)蹤管理(li)(li)(li)和信息化(hua)管理(li)(li)(li),依(yi)托廣西(xi)電(dian)子政務外網(wang)和自治區數據共享交(jiao)換平臺,實(shi)現與(yu)廣西(xi)“互聯網(wang)+監(jian)管”系(xi)統的對接(jie)和相關部(bu)門(men)數據共享互用(yong)。(自治區生(sheng)態(tai)環境(jing)廳牽頭,自治區發展(zhan)改(gai)革委、大數據發展(zhan)局、財(cai)政廳等(deng)(deng)部(bu)門(men)參(can)與(yu))
三、強化危險廢物(wu)源頭管(guan)控
(七)嚴格(ge)執(zhi)行危(wei)險(xian)(xian)廢物(wu)鑒(jian)別(bie)(bie)管(guan)(guan)(guan)理(li)制度。對環(huan)(huan)境(jing)風險(xian)(xian)小的(de)危(wei)險(xian)(xian)廢物(wu)類別(bie)(bie)實(shi)行特定(ding)環(huan)(huan)節豁免管(guan)(guan)(guan)理(li)。按照國家制定(ding)的(de)危(wei)險(xian)(xian)廢物(wu)排除管(guan)(guan)(guan)理(li)清單統(tong)一管(guan)(guan)(guan)理(li)尺度,提(ti)高危(wei)險(xian)(xian)廢物(wu)環(huan)(huan)境(jing)風險(xian)(xian)防范能力。嚴格(ge)執(zhi)行國家危(wei)險(xian)(xian)廢物(wu)鑒(jian)別(bie)(bie)管(guan)(guan)(guan)理(li)相關規定(ding),落實(shi)危(wei)險(xian)(xian)廢物(wu)鑒(jian)別(bie)(bie)規范化管(guan)(guan)(guan)理(li)要求。(自(zi)(zi)治(zhi)區(qu)生態環(huan)(huan)境(jing)廳(ting)牽頭(tou),自(zi)(zi)治(zhi)區(qu)發展改革(ge)委、公安廳(ting)、交(jiao)通(tong)運輸廳(ting)等部門(men)參與)
(八)嚴(yan)把(ba)環(huan)境(jing)(jing)準(zhun)入關。嚴(yan)格執(zhi)行新(xin)改擴(kuo)建(jian)(jian)項(xiang)(xiang)目環(huan)境(jing)(jing)影響評價制度,強(qiang)化(hua)危(wei)(wei)險(xian)廢(fei)物污染環(huan)境(jing)(jing)防治(zhi)設(she)施“三同(tong)時”管理。依(yi)法依(yi)規對已批復的重(zhong)點行業涉危(wei)(wei)險(xian)廢(fei)物建(jian)(jian)設(she)項(xiang)(xiang)目環(huan)境(jing)(jing)影響評價文(wen)件(jian)開(kai)展(zhan)復核。按照國家部(bu)署,依(yi)法落實工業危(wei)(wei)險(xian)廢(fei)物排污許可制度。推進(jin)危(wei)(wei)險(xian)廢(fei)物規范化(hua)環(huan)境(jing)(jing)管理,將危(wei)(wei)險(xian)廢(fei)物日常環(huan)境(jing)(jing)監管納(na)入生態(tai)(tai)環(huan)境(jing)(jing)執(zhi)法“雙隨機、一公開(kai)”內容。(自治(zhi)區生態(tai)(tai)環(huan)境(jing)(jing)廳(ting)負責(ze))
(九)推(tui)動危(wei)(wei)(wei)險(xian)(xian)廢物源頭減量(liang)(liang)化(hua)。支(zhi)持研發(fa)、推(tui)廣減少(shao)(shao)工(gong)(gong)業(ye)危(wei)(wei)(wei)險(xian)(xian)廢物產生(sheng)量(liang)(liang)及(ji)降低(di)工(gong)(gong)業(ye)危(wei)(wei)(wei)險(xian)(xian)廢物危(wei)(wei)(wei)害性的生(sheng)產工(gong)(gong)藝和(he)(he)設備,結(jie)合廣西(xi)產業(ye)結(jie)構(gou)特征,鼓(gu)勵(li)有色金(jin)屬冶煉(lian)、石(shi)化(hua)、化(hua)工(gong)(gong)等(deng)工(gong)(gong)業(ye)企業(ye)集團(tuan)根據需要配(pei)套建設危(wei)(wei)(wei)險(xian)(xian)廢物利用處置設施(shi),促進從源頭上減少(shao)(shao)危(wei)(wei)(wei)險(xian)(xian)廢物產生(sheng)量(liang)(liang)、降低(di)危(wei)(wei)(wei)害性。(自治區工(gong)(gong)業(ye)和(he)(he)信息(xi)化(hua)廳牽頭,自治區發(fa)展(zhan)改革委、生(sheng)態環(huan)境廳等(deng)部門參(can)與)
四、強化危險廢(fei)物收集轉運等(deng)過(guo)程監管
(十)推(tui)動收(shou)集(ji)(ji)(ji)轉(zhuan)運(yun)(yun)貯存專業(ye)(ye)化(hua)。深入(ru)推(tui)進生(sheng)(sheng)(sheng)活垃圾(ji)分類,建(jian)(jian)立有(you)害垃圾(ji)收(shou)集(ji)(ji)(ji)轉(zhuan)運(yun)(yun)體系(xi)(xi)。(自治區住房城鄉建(jian)(jian)設(she)廳(ting)牽頭,相關(guan)部門參(can)與)以(yi)工業(ye)(ye)園區(工業(ye)(ye)集(ji)(ji)(ji)中(zhong)區)等(deng)為重點,規劃(hua)建(jian)(jian)設(she)工業(ye)(ye)固體廢物(wu)(危(wei)險廢物(wu))收(shou)集(ji)(ji)(ji)、暫存和轉(zhuan)運(yun)(yun)體系(xi)(xi)以(yi)及(ji)集(ji)(ji)(ji)中(zhong)貯存設(she)施。落實生(sheng)(sheng)(sheng)產者責任延伸制度,推(tui)進建(jian)(jian)立廢鉛蓄電池、廢礦物(wu)油等(deng)回收(shou)利用體系(xi)(xi)并有(you)效運(yun)(yun)作。開展(zhan)小微企業(ye)(ye)、科研機(ji)構、學(xue)校(xiao)等(deng)產生(sheng)(sheng)(sheng)的危(wei)險廢物(wu)有(you)償(chang)收(shou)集(ji)(ji)(ji)轉(zhuan)運(yun)(yun)服務,鼓勵在有(you)條件的高校(xiao)集(ji)(ji)(ji)中(zhong)區域開展(zhan)實驗室(shi)危(wei)險廢物(wu)分類收(shou)集(ji)(ji)(ji)和預處理示范項(xiang)目(mu)建(jian)(jian)設(she)。(自治區發展(zhan)改革委、工業(ye)(ye)和信息化(hua)廳(ting)、生(sheng)(sheng)(sheng)態環境廳(ting)、交通運(yun)(yun)輸(shu)廳(ting)、教育廳(ting)等(deng)部門按(an)職(zhi)責分工負責)
(十(shi)一)推(tui)進轉移(yi)運(yun)(yun)輸(shu)(shu)便利(li)化(hua)。落實(shi)危險(xian)(xian)(xian)廢(fei)物(wu)(wu)和醫(yi)療廢(fei)物(wu)(wu)運(yun)(yun)輸(shu)(shu)車(che)輛備案制(zhi)度,完善“點對點”的(de)常備通(tong)(tong)行路線(xian),實(shi)現(xian)危險(xian)(xian)(xian)廢(fei)物(wu)(wu)和醫(yi)療廢(fei)物(wu)(wu)運(yun)(yun)輸(shu)(shu)車(che)輛規范有序(xu)(xu)、安全(quan)便捷通(tong)(tong)行。(自(zi)(zi)治區公(gong)安廳(ting)、生態環境(jing)廳(ting)、交(jiao)通(tong)(tong)運(yun)(yun)輸(shu)(shu)廳(ting)、衛生健康委等(deng)部(bu)門(men)(men)按(an)職(zhi)責(ze)分(fen)工負責(ze))根據企業環境(jing)信(xin)用記(ji)錄(lu)和環境(jing)風險(xian)(xian)(xian)可控程(cheng)度等(deng),以“白名單”方式(shi)簡化(hua)危險(xian)(xian)(xian)廢(fei)物(wu)(wu)跨省(sheng)轉移(yi)審(shen)批程(cheng)序(xu)(xu)。維護(hu)危險(xian)(xian)(xian)廢(fei)物(wu)(wu)跨區域轉移(yi)公(gong)平競爭市場(chang)秩序(xu)(xu),嚴禁(jin)設(she)置(zhi)不合理行政壁壘,保障危險(xian)(xian)(xian)廢(fei)物(wu)(wu)跨區域合法轉移(yi)。(自(zi)(zi)治區生態環境(jing)廳(ting)、交(jiao)通(tong)(tong)運(yun)(yun)輸(shu)(shu)廳(ting)等(deng)部(bu)門(men)(men)按(an)職(zhi)責(ze)分(fen)工負責(ze))
(十二(er))嚴(yan)厲打(da)擊涉危(wei)險(xian)(xian)廢(fei)物(wu)(wu)違法(fa)犯罪(zui)行(xing)為。強化危(wei)險(xian)(xian)廢(fei)物(wu)(wu)環(huan)境(jing)執(zhi)法(fa)及案(an)件(jian)(jian)查辦,將(jiang)其作(zuo)為生(sheng)態(tai)環(huan)境(jing)保(bao)護綜合(he)執(zhi)法(fa)重要內容。根(gen)據自治(zhi)區生(sheng)態(tai)環(huan)境(jing)廳、公安廳聯(lian)(lian)合(he)制定的(de)固體廢(fei)物(wu)(wu)環(huan)境(jing)污染(ran)犯罪(zui)案(an)件(jian)(jian)辦理(li)的(de)有(you)關工作(zuo)指引,加快涉危(wei)險(xian)(xian)廢(fei)物(wu)(wu)案(an)件(jian)(jian)的(de)調查處(chu)理(li),嚴(yan)厲打(da)擊非法(fa)傾倒、排放、遺撒危(wei)險(xian)(xian)廢(fei)物(wu)(wu)以(yi)及無危(wei)險(xian)(xian)廢(fei)物(wu)(wu)經營許可證單位實施收集、貯存、轉移、利用、處(chu)置危(wei)險(xian)(xian)廢(fei)物(wu)(wu)等環(huan)境(jing)違法(fa)犯罪(zui)行(xing)為,落實生(sheng)態(tai)環(huan)境(jing)損害(hai)賠償制度,強化行(xing)政執(zhi)法(fa)與刑事司法(fa)、檢察(cha)公益訴訟的(de)協調聯(lian)(lian)動。(自治(zhi)區高(gao)級法(fa)院(yuan),自治(zhi)區檢察(cha)院(yuan),自治(zhi)區公安廳、生(sheng)態(tai)環(huan)境(jing)廳等單位按職(zhi)責分工負責)
五、強化廢棄危(wei)險(xian)化學品監(jian)管(guan)
(十三)建(jian)立監(jian)管(guan)聯動(dong)機制。各級(ji)應(ying)急部(bu)(bu)(bu)門(men)和(he)生態環(huan)(huan)境部(bu)(bu)(bu)門(men)以及其他相關部(bu)(bu)(bu)門(men)建(jian)立監(jian)管(guan)協作和(he)聯合(he)執法工作機制,共(gong)享(xiang)危險化(hua)學品生產企業(ye)和(he)危險廢物經營(ying)單位信息,密(mi)切協調配合(he),形成工作合(he)力。(自治區生態環(huan)(huan)境廳(ting)、應(ying)急廳(ting)等部(bu)(bu)(bu)門(men)按(an)職責(ze)分工負責(ze))
六、建立醫療廢物收集處(chu)置體系

(十八(ba))提升(sheng)危(wei)(wei)(wei)險(xian)廢(fei)物(wu)利(li)用(yong)處(chu)置(zhi)企業(ye)規模化(hua)發(fa)展、專(zhuan)業(ye)化(hua)運(yun)營(ying)水平(ping)。各(ge)設(she)區市人民政府生態環(huan)境等部門(men)(men)定(ding)期發(fa)布危(wei)(wei)(wei)險(xian)廢(fei)物(wu)相關信息,科學引導危(wei)(wei)(wei)險(xian)廢(fei)物(wu)利(li)用(yong)處(chu)置(zhi)產業(ye)發(fa)展。新建(jian)(jian)危(wei)(wei)(wei)險(xian)廢(fei)物(wu)集中(zhong)焚燒處(chu)置(zhi)設(she)施處(chu)置(zhi)能力(li)原(yuan)則上應大(da)于3萬噸(dun)/年,控制可焚燒減(jian)量的(de)危(wei)(wei)(wei)險(xian)廢(fei)物(wu)直接(jie)填埋,適度發(fa)展水泥(ni)窯協同處(chu)置(zhi)危(wei)(wei)(wei)險(xian)廢(fei)物(wu)。落(luo)實(shi)“放管服”改革要(yao)求,鼓(gu)(gu)勵采取多元投(tou)資和(he)(he)市場化(hua)方式(shi)建(jian)(jian)設(she)規模化(hua)危(wei)(wei)(wei)險(xian)廢(fei)物(wu)利(li)用(yong)設(she)施;鼓(gu)(gu)勵企業(ye)通過兼并重組等方式(shi)做大(da)做強(qiang),開展專(zhuan)業(ye)化(hua)建(jian)(jian)設(she)運(yun)營(ying)服務。(自治區發(fa)展改革委、工業(ye)和(he)(he)信息化(hua)廳、生態環(huan)境廳等部門(men)(men)按職責分工負(fu)責)
