借鑒穩評制度建設經驗,推進政策環評制度建設
【谷騰環保網訊】2025年7月,中(zhong)共中(zhong)央辦公(gong)廳(ting)、國務院(yuan)辦公(gong)廳(ting)印發《地方黨政(zheng)領導干部生態(tai)環境(jing)保(bao)護責任制(zhi)(zhi)規定(ding)(試(shi)行(xing)(xing))》,明(ming)確要求(qiu)縣級以上地方政(zheng)府主(zhu)要負責人(ren)“作出重大行(xing)(xing)政(zheng)決(jue)策(ce)應(ying)當對環境(jing)影響和環境(jing)效益進(jin)行(xing)(xing)分(fen)析預測”,這一(yi)規定(ding)進(jin)一(yi)步為政(zheng)策(ce)環評工(gong)作開展提供了(le)直接依據。為此,應(ying)積極推(tui)進(jin)政(zheng)策(ce)環評工(gong)作,為健全(quan)政(zheng)策(ce)評估(gu)制(zhi)(zhi)度(du),提高決(jue)策(ce)科學化(hua)、民主(zhu)化(hua)、法治化(hua)水平,保(bao)障高質量發展和美(mei)麗中(zhong)國建設提供更加(jia)(jia)有效、更加(jia)(jia)直接、更加(jia)(jia)系統(tong)的治理手(shou)段。
筆者認為,在(zai)政策環(huan)(huan)評(ping)(ping)制度(du)建(jian)設(she)(she)過程(cheng)中(zhong),可以(yi)參考借鑒類似(si)制度(du)的建(jian)設(she)(she)經驗(yan),比如(ru)社會穩(wen)(wen)(wen)定(ding)(ding)風(feng)險評(ping)(ping)估(gu)制度(du),即(ji)穩(wen)(wen)(wen)評(ping)(ping)制度(du)。穩(wen)(wen)(wen)評(ping)(ping)是(shi)指在(zai)事關人民(min)群眾切(qie)身(shen)利益(yi)的重大決策事項(xiang)正式出臺前(qian),對其可能引發的社會穩(wen)(wen)(wen)定(ding)(ding)風(feng)險進行評(ping)(ping)估(gu)預測(ce),提出防范和化解措施,并形成(cheng)評(ping)(ping)估(gu)報告的活動。在(zai)政策事前(qian)評(ping)(ping)估(gu)工作中(zhong),穩(wen)(wen)(wen)評(ping)(ping)屬于(yu)(yu)社會影響(xiang)評(ping)(ping)估(gu)范疇,而(er)政策環(huan)(huan)評(ping)(ping)則是(shi)針對政策草案(an)開展的環(huan)(huan)境影響(xiang)評(ping)(ping)估(gu),二者都是(shi)決策科學化、民(min)主化的重要(yao)保障。當(dang)前(qian),穩(wen)(wen)(wen)評(ping)(ping)已成(cheng)為重大政策制定(ding)(ding)的必(bi)經程(cheng)序,分析穩(wen)(wen)(wen)評(ping)(ping)制度(du)的建(jian)設(she)(she)經驗(yan),對于(yu)(yu)政策環(huan)(huan)評(ping)(ping)制度(du)建(jian)設(she)(she)具有重要(yao)的借鑒作用(yong)。
回溯穩(wen)評(ping)制度建立的經過,主要有(you)以下(xia)幾個(ge)重要時(shi)間節(jie)點。2005年(nian)四川(chuan)省遂(sui)寧市在(zai)全國率(lv)先建立了重大工程(cheng)建設項目(mu)穩(wen)定(ding)風險(xian)預測評(ping)估(gu)(gu)制度,并在(zai)2006年(nian)將評(ping)估(gu)(gu)范圍擴展到重大政策(ce)和重大改革措施。隨后,各(ge)地(di)也相繼探索建立社會穩(wen)定(ding)風險(xian)評(ping)估(gu)(gu)制度。在(zai)各(ge)地(di)試(shi)點探索的基礎上,2012年(nian)中(zhong)共中(zhong)央辦公(gong)廳、國務院辦公(gong)廳印發《關于建立健全重大決(jue)策(ce)社會穩(wen)定(ding)風險(xian)評(ping)估(gu)(gu)機制的指(zhi)導意見(試(shi)行)》(中(zhong)辦發〔2012〕2號(hao)),標(biao)志著社會穩(wen)定(ding)風險(xian)評(ping)估(gu)(gu)制度正(zheng)式建立。
筆者認為,總結(jie)穩評(ping)制度(du)建(jian)設經(jing)驗,對(dui)于政策環評(ping)制度(du)建(jian)設的借鑒意義主(zhu)要(yao)有(you)以下幾個方面。
第一,要(yao)(yao)重(zhong)(zhong)點(dian)突出政(zheng)(zheng)(zheng)(zheng)(zheng)策(ce)環(huan)(huan)評(ping)(ping)對美(mei)(mei)麗(li)(li)中(zhong)國(guo)建(jian)(jian)設的(de)支撐服務作用。一項制度(du)的(de)誕生和(he)發展(zhan)需要(yao)(yao)契機。綜合考慮新(xin)時代要(yao)(yao)求(qiu)(qiu)和(he)國(guo)家戰(zhan)略指向,當前(qian)可把政(zheng)(zheng)(zheng)(zheng)(zheng)策(ce)環(huan)(huan)評(ping)(ping)服務美(mei)(mei)麗(li)(li)中(zhong)國(guo)建(jian)(jian)設作為(wei)這項制度(du)建(jian)(jian)設的(de)重(zhong)(zhong)要(yao)(yao)依據。主要(yao)(yao)原因如下:一是(shi)美(mei)(mei)麗(li)(li)中(zhong)國(guo)建(jian)(jian)設已經上升(sheng)為(wei)黨的(de)執政(zheng)(zheng)(zheng)(zheng)(zheng)理(li)念,通(tong)過政(zheng)(zheng)(zheng)(zheng)(zheng)策(ce)環(huan)(huan)評(ping)(ping)可以(yi)將(jiang)美(mei)(mei)麗(li)(li)中(zhong)國(guo)建(jian)(jian)設要(yao)(yao)求(qiu)(qiu)融入經濟社(she)會建(jian)(jian)設各方面。二(er)是(shi)通(tong)過政(zheng)(zheng)(zheng)(zheng)(zheng)策(ce)環(huan)(huan)評(ping)(ping)可以(yi)為(wei)制約(yue)美(mei)(mei)麗(li)(li)中(zhong)國(guo)建(jian)(jian)設的(de)重(zhong)(zhong)大資源(yuan)環(huan)(huan)境(jing)問(wen)題(ti)尋(xun)找解決(jue)(jue)方案。例如,近年(nian)來很(hen)多能源(yuan)基地的(de)煤矸石、粉(fen)煤灰等(deng)工業(ye)固廢難以(yi)處置利(li)用,已經成(cheng)為(wei)困擾(rao)當地生態(tai)環(huan)(huan)境(jing)管理(li)的(de)重(zhong)(zhong)大難題(ti),通(tong)過政(zheng)(zheng)(zheng)(zheng)(zheng)策(ce)環(huan)(huan)評(ping)(ping)可以(yi)調動(dong)(dong)各方共同尋(xun)找解決(jue)(jue)方案。三是(shi)通(tong)過政(zheng)(zheng)(zheng)(zheng)(zheng)策(ce)環(huan)(huan)評(ping)(ping)可以(yi)推動(dong)(dong)相(xiang)關(guan)政(zheng)(zheng)(zheng)(zheng)(zheng)策(ce)協(xie)同協(xie)調,更(geng)好形成(cheng)以(yi)習(xi)近平生態(tai)文明思想為(wei)統領(ling)的(de)美(mei)(mei)麗(li)(li)中(zhong)國(guo)建(jian)(jian)設政(zheng)(zheng)(zheng)(zheng)(zheng)策(ce)體系。
第(di)二(er),要通(tong)過(guo)試(shi)點(dian)項目(mu)以(yi)(yi)點(dian)帶面推(tui)動(dong)政(zheng)策(ce)(ce)(ce)環(huan)(huan)(huan)評(ping)制(zhi)(zhi)度(du)建(jian)(jian)設。我(wo)國(guo)對(dui)(dui)于(yu)一項新制(zhi)(zhi)度(du)的(de)建(jian)(jian)立,往(wang)(wang)往(wang)(wang)遵循(xun)“地方試(shi)點(dian)—中(zhong)央推(tui)廣(guang)(guang)—各(ge)地學(xue)習—經(jing)驗總結—建(jian)(jian)章立制(zhi)(zhi)”的(de)路徑。社(she)會(hui)穩定風險評(ping)估制(zhi)(zhi)度(du)自遂寧(ning)市首創以(yi)(yi)來,經(jing)過(guo)推(tui)廣(guang)(guang),各(ge)地在(zai)試(shi)點(dian)過(guo)程中(zhong)形成了多種范式。最(zui)后,中(zhong)央在(zai)總結各(ge)地經(jing)驗的(de)基礎上對(dui)(dui)其進(jin)行(xing)規(gui)范,這(zhe)項制(zhi)(zhi)度(du)才最(zui)終(zhong)確(que)立。對(dui)(dui)于(yu)政(zheng)策(ce)(ce)(ce)環(huan)(huan)(huan)評(ping)而(er)言(yan),可(ke)(ke)以(yi)(yi)進(jin)一步通(tong)過(guo)試(shi)點(dian)項目(mu)以(yi)(yi)點(dian)帶面推(tui)動(dong)政(zheng)策(ce)(ce)(ce)環(huan)(huan)(huan)評(ping)制(zhi)(zhi)度(du)建(jian)(jian)設。一是(shi)(shi)針(zhen)對(dui)(dui)國(guo)家和地方重大政(zheng)策(ce)(ce)(ce)開展政(zheng)策(ce)(ce)(ce)環(huan)(huan)(huan)評(ping),不僅可(ke)(ke)以(yi)(yi)為(wei)政(zheng)策(ce)(ce)(ce)制(zhi)(zhi)定提(ti)(ti)供實質性(xing)支(zhi)撐,而(er)且可(ke)(ke)以(yi)(yi)起(qi)到示范作用。二(er)是(shi)(shi)通(tong)過(guo)試(shi)點(dian)對(dui)(dui)政(zheng)策(ce)(ce)(ce)環(huan)(huan)(huan)評(ping)模式、適(shi)用技術方法、工作機制(zhi)(zhi)等(deng)進(jin)行(xing)全(quan)面探索,可(ke)(ke)以(yi)(yi)為(wei)制(zhi)(zhi)度(du)建(jian)(jian)設積(ji)累經(jing)驗。三(san)是(shi)(shi)依托試(shi)點(dian)可(ke)(ke)以(yi)(yi)對(dui)(dui)政(zheng)策(ce)(ce)(ce)環(huan)(huan)(huan)評(ping)進(jin)行(xing)宣傳推(tui)廣(guang)(guang),特別是(shi)(shi)可(ke)(ke)以(yi)(yi)提(ti)(ti)高政(zheng)策(ce)(ce)(ce)制(zhi)(zhi)定部門對(dui)(dui)政(zheng)策(ce)(ce)(ce)環(huan)(huan)(huan)評(ping)工作的(de)認(ren)識。就當(dang)前而(er)言(yan),可(ke)(ke)重點(dian)從京津冀(ji)協同發展、新質生產(chan)力培育、減污(wu)降碳(tan)協同增效等(deng)領(ling)域(yu)選取具體政(zheng)策(ce)(ce)(ce)開展試(shi)點(dian)。
第三(san),要(yao)充分(fen)發揮《重大行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)決(jue)策(ce)(ce)(ce)(ce)程(cheng)(cheng)序(xu)暫行(xing)(xing)條例(li)》的(de)(de)(de)(de)(de)指導(dao)作(zuo)(zuo)(zuo)用。2019年國(guo)(guo)務院頒布實施的(de)(de)(de)(de)(de)《重大行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)決(jue)策(ce)(ce)(ce)(ce)程(cheng)(cheng)序(xu)暫行(xing)(xing)條例(li)》(以(yi)(yi)下簡稱《條例(li)》)將(jiang)“風(feng)(feng)險評(ping)(ping)估(gu)”單(dan)列,被穩(wen)評(ping)(ping)從(cong)業人(ren)員認為(wei)(wei)是(shi)開展這項(xiang)工(gong)作(zuo)(zuo)(zuo)的(de)(de)(de)(de)(de)直接依據(ju)(ju)。事實上(shang),《條例(li)》涉(she)(she)及(ji)社會、經(jing)(jing)濟(ji)、生態(tai)環(huan)(huan)境等多(duo)個方(fang)面(mian),并(bing)且(qie)(qie)貴(gui)州(zhou)、重慶、天(tian)津等地已明確將(jiang)生態(tai)環(huan)(huan)境作(zuo)(zuo)(zuo)為(wei)(wei)風(feng)(feng)險評(ping)(ping)估(gu)的(de)(de)(de)(de)(de)重要(yao)內容。對(dui)于政(zheng)(zheng)(zheng)(zheng)策(ce)(ce)(ce)(ce)環(huan)(huan)評(ping)(ping)而言,過去一(yi)直依照《環(huan)(huan)境保護(hu)法》第十四條“國(guo)(guo)務院有(you)關部門和(he)(he)省、自治(zhi)區、直轄(xia)市人(ren)民政(zheng)(zheng)(zheng)(zheng)府(fu)組織制(zhi)定經(jing)(jing)濟(ji)、技術政(zheng)(zheng)(zheng)(zheng)策(ce)(ce)(ce)(ce),應當充分(fen)考(kao)慮對(dui)環(huan)(huan)境的(de)(de)(de)(de)(de)影(ying)響,聽取有(you)關方(fang)面(mian)和(he)(he)專(zhuan)家(jia)的(de)(de)(de)(de)(de)意見(jian)”開展工(gong)作(zuo)(zuo)(zuo),并(bing)且(qie)(qie)將(jiang)經(jing)(jing)濟(ji)、技術政(zheng)(zheng)(zheng)(zheng)策(ce)(ce)(ce)(ce)作(zuo)(zuo)(zuo)為(wei)(wei)主要(yao)評(ping)(ping)價對(dui)象。在此基(ji)礎上(shang),可將(jiang)《條例(li)》作(zuo)(zuo)(zuo)為(wei)(wei)政(zheng)(zheng)(zheng)(zheng)策(ce)(ce)(ce)(ce)環(huan)(huan)評(ping)(ping)的(de)(de)(de)(de)(de)重要(yao)依據(ju)(ju)。一(yi)是(shi)《條例(li)》第十二條明確提出(chu)決(jue)策(ce)(ce)(ce)(ce)承辦單(dan)位要(yao)對(dui)決(jue)策(ce)(ce)(ce)(ce)事項(xiang)涉(she)(she)及(ji)的(de)(de)(de)(de)(de)資源消(xiao)耗、環(huan)(huan)境影(ying)響和(he)(he)環(huan)(huan)境效益(yi)進行(xing)(xing)分(fen)析預(yu)測,而最有(you)效的(de)(de)(de)(de)(de)分(fen)析工(gong)具就是(shi)政(zheng)(zheng)(zheng)(zheng)策(ce)(ce)(ce)(ce)環(huan)(huan)評(ping)(ping)。二是(shi)自《條例(li)》頒布后,中央層面(mian)的(de)(de)(de)(de)(de)后續文件(jian)中已經(jing)(jing)很(hen)少單(dan)獨(du)提到社會穩(wen)定風(feng)(feng)險,而是(shi)賦予(yu)風(feng)(feng)險評(ping)(ping)估(gu)更加豐富(fu)的(de)(de)(de)(de)(de)內容,其中就包(bao)含環(huan)(huan)境風(feng)(feng)險。三(san)是(shi)既然針對(dui)政(zheng)(zheng)(zheng)(zheng)策(ce)(ce)(ce)(ce)的(de)(de)(de)(de)(de)社會穩(wen)定風(feng)(feng)險評(ping)(ping)估(gu)可以(yi)(yi)將(jiang)《條例(li)》作(zuo)(zuo)(zuo)為(wei)(wei)直接依據(ju)(ju)單(dan)獨(du)開展,那么(me)政(zheng)(zheng)(zheng)(zheng)策(ce)(ce)(ce)(ce)環(huan)(huan)評(ping)(ping)也可以(yi)(yi)將(jiang)其作(zuo)(zuo)(zuo)為(wei)(wei)直接依據(ju)(ju)單(dan)獨(du)開展。
第四,要(yao)建(jian)(jian)立鼓勵(li)地方(fang)政(zheng)(zheng)府(fu)開(kai)展政(zheng)(zheng)策(ce)環(huan)(huan)評(ping)的(de)(de)(de)激(ji)(ji)勵(li)機(ji)制(zhi)(zhi)。社會(hui)穩定風險評(ping)估的(de)(de)(de)主(zhu)要(yao)作(zuo)(zuo)用是(shi)防范(fan)和化(hua)解社會(hui)風險,但同時也是(shi)地方(fang)政(zheng)(zheng)府(fu)規(gui)(gui)避決策(ce)風險、掃清決策(ce)障礙的(de)(de)(de)有效(xiao)工(gong)具(ju),甚至(zhi)可(ke)以(yi)(yi)(yi)成為其宣(xuan)傳決策(ce)正(zheng)面影(ying)響的(de)(de)(de)平臺(tai)。對(dui)(dui)于(yu)政(zheng)(zheng)策(ce)環(huan)(huan)評(ping)而(er)言(yan),過(guo)去政(zheng)(zheng)策(ce)制(zhi)(zhi)定部門之所以(yi)(yi)(yi)缺乏主(zhu)動性(xing),主(zhu)要(yao)是(shi)擔(dan)心(xin)會(hui)對(dui)(dui)其決策(ce)構成制(zhi)(zhi)約(yue)。如(ru)果(guo)能(neng)(neng)夠建(jian)(jian)立相關激(ji)(ji)勵(li)機(ji)制(zhi)(zhi),情(qing)況(kuang)可(ke)能(neng)(neng)會(hui)完(wan)全改(gai)觀(guan)。具(ju)體而(er)言(yan):一(yi)是(shi)可(ke)以(yi)(yi)(yi)將政(zheng)(zheng)策(ce)環(huan)(huan)評(ping)納入地方(fang)政(zheng)(zheng)府(fu)績效(xiao)考核體系(xi),提高其開(kai)展此項(xiang)(xiang)(xiang)(xiang)工(gong)作(zuo)(zuo)的(de)(de)(de)積極性(xing)。二是(shi)對(dui)(dui)于(yu)政(zheng)(zheng)策(ce)環(huan)(huan)評(ping)中涉及的(de)(de)(de)規(gui)(gui)劃和重大項(xiang)(xiang)(xiang)(xiang)目,政(zheng)(zheng)策(ce)環(huan)(huan)評(ping)結論不僅可(ke)以(yi)(yi)(yi)作(zuo)(zuo)為規(gui)(gui)劃環(huan)(huan)評(ping)和項(xiang)(xiang)(xiang)(xiang)目環(huan)(huan)評(ping)的(de)(de)(de)依據(ju)(ju),而(er)且可(ke)以(yi)(yi)(yi)據(ju)(ju)此簡化(hua)相關工(gong)作(zuo)(zuo)。三是(shi)對(dui)(dui)于(yu)困擾(rao)環(huan)(huan)境準(zhun)入的(de)(de)(de)一(yi)些政(zheng)(zheng)策(ce)性(xing)問題,可(ke)以(yi)(yi)(yi)通過(guo)政(zheng)(zheng)策(ce)環(huan)(huan)評(ping)找出解決方(fang)案,為規(gui)(gui)劃的(de)(de)(de)編制(zhi)(zhi)、實施乃至(zhi)建(jian)(jian)設項(xiang)(xiang)(xiang)(xiang)目環(huan)(huan)境準(zhun)入提供依據(ju)(ju)。
